Seller’s Responsibility:

  1. The Seller guarantees that the puppy is in good health (minus potential intestinal parasites) and has received the following:

    1. First immunizations

    2. Subcutaneous microchip

    3. Routine deworming

  2. The Seller provides warranty against debilitating congenital defects until the puppy is a year old.

    1. The Seller guarantees genetic testing has been performed on the sire and dam to prevent hereditary issues with their offspring.

    2. Debilitating congenital defects are defined as those present since birth that are either life-threatening or would prevent the puppy from fulfilling the intended purpose for which it was purchased (as a companion).

    3. Any suspected debilitating congenital defect must be confirmed by a licensed veterinarian (including necropsy if the dog dies).

      1. Buyer must supply any requested veterinary records related to the dog’s condition to the Seller within seven days of diagnosis.

      2. Seller has the right to require a second opinion from a veterinarian and/or veterinary specialist of the Seller’s choice at the Seller’s expense.

      3. If necropsy is performed and results in undetermined or inconclusive diagnosis, warranty is void.

    4. If a congenital defect is identified within the warranty period, the Buyer has the option to obtain a replacement puppy from the Seller of equal or lesser value from the next available litter.

      1. Original puppy need not be returned, provided there is proper documentation of congenital issue.

      2. Breeder determines which puppy (of equal or lesser value) will be used as a replacement and the wait may be as long as 6-12 months.

      3. Color or gender is not guaranteed.

      4. Shipping fees will not be refunded, and any cost associated with the shipping placement puppy are to be covered by Buyer.

    5. If puppy is euthanized or in any way disposed of, without a second opinion from the Seller’s veterinarian of choice, the Buyer waives all rights to a replacement puppy.

    6. This warranty does not include viral illnesses, infections, undescended testicles, improper bites (underbites, overbites, base narrow canines, etc), stress-related illnesses, hernias, hypoglycemia, parasites (including, but not limited to, Giardia and Coccidiosis), cancer, seizures or endocrine disorders.  It also does not include any illness due to the ingestion of foreign objects, food, chemicals or physical injury.

    7. No warranties or guarantees, expressed or implied, are made under this contract except as stated.

    8. This warranty is non-transferable.

  3. It is to be clearly understood that the Seller does NOT, under any circumstances, accept responsibility for any veterinarian and/or health care expense after the puppy leaves their care.

  4. It is understood that Seller cannot guarantee adult size of the puppy, color or temperament and that training is highly recommended. .

Buyer’s Responsibility:

  1. The Buyer agrees to pay the Seller a total sum of $2700. This fee does not include shipping.  If shipping is required, the Buyer agrees to arrange for shipping by the time the puppy is ready to go home.

  2. If the puppy is staying past 9 weeks, Buyer understands there is an additional $15/day if the puppy is reserved prior to 8 weeks.

  3. The Buyer bears all costs relating to the sale of the above animal, including transportation.  The risk or loss or injury to the above animal is on the Buyer at all times after the puppy leaves the Seller.

  4. Buyer agrees to activate free trial of Trupanion within 24 hours of bringing home their puppy. Failure to do so will void the health guarantee.

  5. The Buyer agrees to have the puppy examined by a licensed veterinarian within 3 business days of taking possession.

    1. If the puppy is found to be in poor health at this appointment, the Buyer has the option of returning the puppy to the Seller, at Buyer’s cost for a full refund (minus deposit amount of $300).

    2. The Buyer will provide a written statement from a licensed veterinarian clearly stating the defect or illness and will allow Seller to speak with the veterinarian if they wish.

    3. If the puppy is not taken to a licensed veterinarian within 3 business days of taking possession, the health warranty is void.

    4. Please ensure that the puppy is kept in a kennel or held in the waiting room of a veterinary office, and that the exam room is properly disinfected before the appointment to minimize the risk of exposure to illnesses such as parvo.

  6. The Buyer is responsible for all medical expenses associated with the treatment of intestinal parasites if the puppy is diagnosed, even if the puppy has parasites when it is sent home.

    1. If you are not willing to treat puppy parasites, then please do not buy a puppy.

    2. It is common for puppy parasites to flourish after joining their new family (stress and change accommodate this).

    3. Many parasites can be contagious, and it is possible that other dogs in your home can get them.

    4. Do not let your other dogs eat your puppy’s feces and clean it up immediately using proper cleaning chemicals.

    5. A monthly parasite preventative should be continued.

  7. The Buyer agrees to provide the best possible care for their puppy for the duration of his or her life.  This includes, but is not limited to:

    1. Housing the puppy indoors

    2. Feeding only a premium quality, complete food intended for dogs

    3. Maintaining their puppy at a healthy weight

    4. Having their puppy seen by a licensed veterinarian for a wellness exam annually

    5. Taking their puppy to a licensed veterinarian if he or she gets sick or injured

    6. Keeping all immunizations current according to the guidelines of the American Veterinary Association, or performing titers

    7. Administering heartworm/ parasite preventative medication

    8. Registration of microchip

  8. The Seller highly recommends the Buyer provide basic obedience training with their puppy within the first year of owning their puppy with a professional trainer.

  9. The Buyer agrees to postpone strenuous, forced exercise until after the puppy is over one (1) year of age to minimize joint damage as puppies develop.

  10. The Buyer agrees to contact the Seller immediately if the Buyer determines they are unable to keep their puppy for any reason.  Buyer understands they are not allowed to sell the dog at any point in the dog’s life. Because dog ownership is a lifetime commitment, refunds will not be provided if the dog is returned to the breeder at any point in time.

  11. The Buyer agrees to never place their puppy with a rescue group, in a shelter, pound, or similar facility or research laboratory.

  12. The Buyer allows the Seller to use any pictures of the dog that the Buyer posts on social media for the purposes of reposting and sharing on Facebook, Instagram, their website, Twitter, YouTube, etc or in any manner they choose.

Spay and Neuter Contract

  1. Spaying/neutering/gonad sparing surgery (GSS) by a licensed, reputable veterinarian is required on the above puppy by 24 months of age.

    1. Proof of this, in the form of a Certificate of Spay/Neuter from the veterinarian, must be forwarded to the Seller by the time the puppy reaches 24 months of age.

    2. It is understood that at the time of sale that the puppy is not to be used for breeding.  It is a representation of its breed, and it is structurally and temperamentally suited for a companion and/or working dog (ESA, etc).  It is being sold as a pet without breeding rights.

    3. If the dog is bred intentionally or accidentally, Buyer will owe an additional $2000 for breeding rights.

Conflict Resolution

 

1.      Mediation.  Seller and Buyer agree to mediate any dispute or claim arising between them out of this Contract, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.  If, for any dispute or claim to which this paragraph applies, any party commences an action without first attempting to resolve the matter through mediation or refuses to mediate after a request has been made, then that party shall not be entitled to recover attorney fees, even if they would otherwise be available to that party in any such action.

2.      With the exception stated in above in any action, proceeding, or arbitration between Seller and Buyer arising out of this Contract, the prevailing party shall be entitled to reasonable attorney fees, costs, and penalties from the non-prevailing party.

3.     This contract shall be deemed a legally binding contract and is under the jurisdiction of Campbell County in the State of Virginia.
